Terms of use

1. Scope of Application

These General Terms and Conditions of Sale (hereafter “Terms”) apply to all guided tours, private tours, group experiences, destination management services, and related services sold by Unseen Paris.

By booking a service, the client acknowledges having read and accepted these Terms without reservation.

These Terms are governed by French law and comply with the provisions of the French Tourism Code (Code du Tourisme) and the French Consumer Code (Code de la Consommation).

2. Booking & Confirmation

A booking is confirmed only upon:

  • Written confirmation (email or online booking confirmation), and

  • Receipt of the required deposit or full payment.

Unseen Paris reserves the right to refuse a booking in the event of non-payment, incomplete information, or exceptional circumstances.

3. Pricing & Payment

All prices are listed in Euros (€) and include applicable VAT unless otherwise specified.

Payment terms:

  • Private tours: Full payment required at time of booking unless otherwise agreed.

  • Large group or custom events: A non-refundable deposit of 30–50% may be required, with balance due prior to the event.

Unseen Paris reserves the right to modify prices before booking confirmation.

4. Right of Withdrawal (Droit de Rétractation)

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to leisure activities provided on a specific date or period.

Therefore, tours and event bookings are non-refundable once confirmed, subject to the cancellation policy below.

5. Cancellation Policy

5.1 By the Client

Unless otherwise specified in writing:

  • Cancellation more than 14 days before the tour: Refund minus administrative fee (if applicable).

  • Cancellation 7–14 days before: 50% refund.

  • Cancellation less than 7 days before: No refund.

  • No-show: No refund.

For large groups or custom events, cancellation terms may differ and will be specified in the service contract.

All cancellations must be made in writing via email.

5.2 By Unseen Paris

Unseen Paris reserves the right to cancel or modify a tour due to:

  • Force majeure (as defined under French Civil Code Article 1218),

  • Extreme weather,

  • Government restrictions,

  • Safety concerns,

  • Guide illness or unforeseen circumstances.

In such cases, clients will be offered:

  • A rescheduled date, or

  • A full refund of the affected service.

No additional compensation shall be due.

6. Modifications

Clients may request modifications (date change, time adjustment) subject to availability.

Unseen Paris does not guarantee that modifications can be accommodated, particularly within 7 days of the tour date.

Additional costs may apply.

7. Client Responsibility

Clients must:

  • Arrive on time at the agreed meeting point indicated in the booking confirmation,

  • Provide accurate and complete information at the time of booking,

  • Ensure they are physically capable of participating in the tour unless otherwise arranged in advance.

In the event of late arrival, the tour duration may be shortened accordingly without any refund or compensation.

If a client is more than 30 minutes late after the scheduled meeting time, and no prior written notice has been received, the assigned tour guide reserves the right to consider the service cancelled and to leave the meeting point at their discretion.

In such circumstances, the tour shall be considered a no-show, and no refund shall be issued.

8. Liability

Unseen Paris is covered by professional civil liability insurance in accordance with French regulations.

Unseen Paris shall not be liable for:

  • Personal injury resulting from client negligence,

  • Loss or theft of personal belongings,

  • Third-party services not directly operated by Unseen Paris (restaurants, transport providers, museums, etc.).

Liability is limited to the amount of the service purchased.

9. Force Majeure

In accordance with Article 1218 of the French Civil Code, Unseen Paris shall not be held liable for failure to perform obligations due to unforeseeable and unavoidable events beyond its control.

This includes but is not limited to: natural disasters, strikes, pandemics, government decisions, transportation disruptions.

10. Insurance

Clients are strongly encouraged to obtain personal travel insurance covering:

  • Cancellation,

  • Medical expenses,

  • Personal liability,

  • Theft or loss of personal belongings.

11. Image Rights

During tours, photographs or videos may occasionally be taken for promotional purposes.

Clients who do not wish to appear in promotional material must notify Unseen Paris in writing prior to the tour.

12. Data Protection (RGPD Compliance)

Personal data collected during booking is processed in accordance with the General Data Protection Regulation (EU Regulation 2016/679).

Data is used solely for:

  • Booking management,

  • Client communication,

  • Legal accounting obligations.

Clients have the right to access, modify, or request deletion of their data by contacting: booking@unseenparis.com.

13. Disputes & Mediation

In the event of a dispute, the client must first contact Unseen Paris in writing to seek an amicable resolution.

If no agreement is reached, the client may refer the matter to a consumer mediator in accordance with Articles L612-1 and following of the Consumer Code.

In the absence of amicable resolution, disputes shall fall under the jurisdiction of the competent French courts.

14. Governing Law

These Terms are governed exclusively by French law.
